Set out below are the terms and conditions on which Olivia Shaw Acupuncture Limited (“the Company”) provides services to its patients. Please read the terms and conditions below before booking an appointment and please ask if there is anything that you do not understand before making a booking.
- Overview
1.1 Booking an appointment with the Company indicates your acceptance of these terms and conditions and constitutes an Agreement between you and the Company
1.2 You represent that you have read, understood and agree to be bound by these terms and conditions and that you are at least 18 years old.
1.3 An assessment will always be made as to whether treatment is suitable for you or likely to be successful or not, based on previous experience and prior to any treatment being carried out. Results cannot be guaranteed as they vary from person to person due to many factors.
1.4 The Company’s website aims to help you consider the services it provides. The Company and its practitioners do not offer any medical advice via the website.
2. Booking Process
2.1. New patients can make bookings by email, website contact form or telephone enquiry.
Existing patients of the Company can also make bookings online using the Company’s scheduling platform via a unique link.
2.2. By booking an appointment you confirm that you are seeking acupuncture services and have provided accurate and complete information.
2.3 The Company reserves the right to withdraw access to the online booking system from any patient who repeatedly cancels or reschedules appointments online without attending an appointment or for any reason at its discretion, for example, failing to act in according with clauses 5.2 and 8.1 below.
3. Appointment Availability
3.1. Appointments are subject to availability.
3.2. The Company strives to maintain accurate and up-to-date availability information, but does not guarantee the availability of specific appointment times.
4. Cancellation and Rescheduling
4.1. The Company retains the right to refuse to make an appointment or to cancel or reschedule appointments at its discretion.
4.2 The Company will endeavour to ensure that your appointment runs to time.
4.3 If the Company has to cancel or postpone your appointment at short notice, every effort will be made to contact you in advance as soon as possible.
4.4 If you need to cancel or reschedule an appointment, please do so at least 24 hours in advance. Failure to do so will result in a cancellation fee being charged.
4.5 If you are late for an appointment it may not be possible to exceed the time slot reserved for you and in some cases it may not be feasible to start the session. Please inform your practitioner of any delay.
4.6 Your session may be cancelled if you are more than 15 minutes late for an appointment and you will be charged a late cancellation fee.
5. Fees and Payments
5.1. The fees for acupuncture services are clearly stated on the Company’s website and are subject to change.
5.2 Payment for treatment is due in full at the end of your session by card, secure payment link sent by email by the Company or by cheque.
5.3 If you do not pay the Company at the end of your appointment and you still do not make payment within seven days of the Company reminding you that payment is due, the Company may suspend the supply of its services (including cancelling any scheduled appointments) until you have paid the outstanding amounts.
6. Health and Medical Information
6.1. You agree to provide accurate health and medical information during the booking process and/or consultation.
6.2 You agree to update your practitioner if, during the course of your treatments, there are any changes to your health status and/or you begin taking or stop taking any new medications or supplements.
6.3 When a significant period of time has elapsed since your last treatment, the Company reserves the right to ask for a full and updated medical history and undertake a further initial acupuncture consultation appointment.
6.4 Advice and treatments provided by the Company are not an alternative to conventional medical opinion or treatment.
7. CCTV
7.1 CCTV is used by the licensor (Unit Management Limited) in the common parts of Liberty House, but there is no CCTV in the treatment room. If you attend Liberty House, you may be captured on CCTV in the common parts of the building by Unit Management Limited.
8. Conduct during treatment and on the clinic premises
8.1 Patients attending for treatment are expected to demonstrate respectful conduct
8.2 The Company has the right to refuse, discontinue or defer treatment for any reason and has the right to do so without explaining why this decision has been made. The Company will always try to provide you with as much notice as possible and some alternative acupuncture practitioners who would be suitable for you.
9. Changes to these Terms and Conditions
9.1. The Company reserves the right to update these terms and condition or introduce new terms and conditions at any time without prior notice.
10. Third party rights
10.1This Agreement is only for the benefit of you and no other person can claim a benefit from this agreement by virtue of the Contracts (Rights of Third Parties) Act 1999 which Act shall not apply to this Agreement.
11 Indemnity
11.1 You agree to indemnify and hold harmless the Company from and against any, and all claims, losses, demands, causes of action and judgments (including solicitors’ fees and court costs) arising from or concerning any breach by you of this Agreement and/or these Terms and Conditions and you agree to reimburse the Company on demand for any losses, costs, or expenses incurred as a result thereof.
12. Confidentiality
12.1. Any personal and health information provided during the booking process will be kept confidential in accordance with the Company’s Privacy Policy.
13. Disclaimer
13.1. Acupuncture is not a replacement for medical diagnosis, treatment, or care.
13.2. The Company does not guarantee specific outcomes or results from acupuncture treatments. Proceeding with a consultation/appointment acknowledges your understanding and agreement to this.
14. Liability
14.1 The Company does not exclude or limit in any way its liability to you where it would be unlawful to do so.
14.2 The Company will not be liable in contract, tort or otherwise for any economic loss (including, without limitation, loss of profit), or for any other special, indirect, or consequential loss or damage arising out of, or in connection with, its provision of any goods and/or services to you.
14.3 It is your responsibility to ensure that you provide the Company with all relevant medical details prior to each treatment. The Company will not be liable for any damage or loss that occurs because of your failure to disclose such details.
15 Law and legal notices
15.1 This Agreement and any other terms or documents referred to in this agreement represent your entire agreement with the Company with respect to your contract for the supply of treatments or products and your use of the Company’s website. If any part of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with the applicable law to reflect, as closely as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. English Law governs our Agreement and your use of the website, and you expressly agree that the English courts shall have exclusive jurisdiction over any claim or dispute between us or relating in any way to your contract with the Company or your use of its website.
